O-1 Visa

 The O-1 visa is a temporary visa that is issued to the team member who holds “extraordinary ability” in what they do. The visa requires an employer sponsor and is valid for up to 3 years. To qualify for an extraordinary ability visa, USCIS will look for:

• Documentation of nationally or internationally recognized prizes or awards;
• Documentation of membership in associations which require outstanding achievements of their members;
• Published material about the immigrant’s work in the media;
• Evidence of the immigrant’s participation as a judge of the work of others;
• Evidence of original contributions of major significance in the field;
• Evidence of authorship of scholarly articles in the field;
• Evidence the immigrant has been employed by distinguished organizations in a leading or critical role; and
• Evidence that the immigrant has required a high salary in relation to others in the field.

EB-1 Visa

 The EB-1 visa is a permanent visa application which would lead to permanent residence in the United States after separate application and approval. The standard for the EB-1 visa is remarkably similar to the requirements of the O-1 visa (listed above). However, the EB-1 visa is reviewed with more scrutiny and must also show that the immigrant’s work will benefit the United States prospectively and that they intend to continue to work in their area of expertise after issuance of the permanent residency. P-1 Visa

The P-1 visa is a temporary visa issued for one to five years and requires a sponsor. To qualify for a P-1 visa, you must be a professional athlete, amateur athlete, a member of an internationally recognized athletic team, an internationally recognized individual athlete.
